Terms of Use

These Terms govern use of the GetMuso mobile app, public marketplace and shareable musician profiles. They apply to customers, musicians and anyone else who uses the service.

1. Accepting these Terms

By using GetMuso, you agree to these Terms and acknowledge the Privacy Policy. A musician must actively accept both when creating an account. If you are not legally able to agree to these Terms, use GetMuso only with the involvement of a parent, guardian or other person legally authorised to act for you.

2. What GetMuso provides

GetMuso is a discovery and enquiry marketplace for live musicians in Gqeberha and the surrounding Eastern Cape launch region. Customers can browse public profiles, save favourites on their device and send booking enquiries. Musicians can use one GetMuso account to manage a hosted profile, availability and enquiries.

GetMuso is not a booking agent, employer, venue, payment service, insurer or party to an agreement between a customer and musician. Payments, escrow and contracts are outside the launch service. GetMuso does not guarantee that a musician will respond, be available, accept an enquiry or perform, and does not guarantee that a customer will proceed with an event.

3. Enquiries are not confirmed bookings

A GetMuso enquiry is only a request to the selected musician. The musician may contact the customer directly using the supplied contact details. A booking exists only if the customer and musician separately agree its scope, price, timing and any other terms. Each party is responsible for checking the identity, suitability, venue, safety, permits, equipment and contractual arrangements relevant to the event.

Availability shown in GetMuso reflects information maintained by the musician and may change. Customers should confirm the final date and time directly with the musician.

4. Accounts and account security

  • Customer browsing and guest enquiries do not require an account. GetMuso accounts are for musicians managing profiles and for administrators.
  • Provide accurate, current account information and keep your password and device access secure.
  • Use your own account. Do not impersonate another person, transfer access without permission or create accounts to evade a restriction.
  • Tell GetMuso promptly at admin@getmuso.co.za if you believe an account has been compromised.

5. Musician profiles and approval

A musician is responsible for ensuring that profile claims, rates, packages, availability, service areas, links and media are accurate and lawful. Profiles remain private until submitted and approved. GetMuso may request changes, reject, hide or remove a profile to protect customers, enforce these Terms or maintain marketplace quality. Approval is a content and marketplace review; it is not an endorsement, background check or guarantee of a musician’s identity, qualifications or performance.

6. Content you provide

You keep ownership of content you submit. You give GetMuso a non-exclusive, worldwide, royalty-free licence to host, store, resize, reproduce and display that content as reasonably necessary to operate and present the service. This licence ends when the content is deleted from active GetMuso systems, subject to reasonable backup rotation and content already shared or cached outside GetMuso’s control.

You confirm that you have the rights and permissions needed for submitted names, descriptions, photos, logos, recordings and links, including permission from identifiable people where required. Do not submit unlawful, misleading, defamatory, infringing, exploitative or privacy-invasive content.

7. Acceptable use

You must not:

  • send spam, fraudulent enquiries, harassment or abusive material;
  • scrape, crawl or automate access except through a search engine or interface GetMuso permits;
  • probe, bypass or interfere with authentication, rate limits, access controls or service security;
  • upload malware or use GetMuso to break a law or another person’s rights;
  • misrepresent availability, pricing, identity or the status of a booking; or
  • reuse another musician’s profile or personal information without permission.

Anyone can send GetMuso a private report about a public profile and can hide that profile on their own device. GetMuso may review reports, preserve relevant evidence, contact an affected account holder, hide or remove content, or restrict an account. Do not knowingly submit false, repetitive or abusive reports.

A musician can privately report an abusive enquiry and block that sender from sending later enquiries to the musician using the same account or contact identities. The musician can remove the block. GetMuso administrators may review the reported message and resolution history. Structured sender contact/account fields and block fingerprints are omitted from the administrator moderation queue, although the message may contain personal information the sender chose to write.

8. External services

Profiles may link to social, video, music, email, messaging, map or other third-party services. Phone features may also open a calendar or another app at your request. GetMuso does not control those services and is not responsible for their content, availability, terms or privacy practices. Use them at your own discretion.

9. Suspending or ending access

GetMuso may restrict, suspend or end access, hide content or preserve relevant records when reasonably necessary to investigate abuse, protect users, comply with law or enforce these Terms. A musician can temporarily take a profile offline or use recoverable profile removal without deleting the account. Permanent account deletion is separate and is described on the Account deletion page.

10. Service availability and responsibility

GetMuso is provided on an “as available” basis. We work to keep the service accurate, safe and available, but interruptions and errors can occur. To the fullest extent permitted by law, GetMuso is not liable for indirect, incidental or consequential loss arising from use of the service or from arrangements between customers and musicians.

Nothing in these Terms excludes liability or consumer rights that South African law does not allow to be excluded, including liability that cannot lawfully be limited under the Consumer Protection Act or other applicable law.

11. Privacy

The Privacy Policy explains what personal information GetMuso processes, why it is used, who receives it, how long it is kept and how to exercise POPIA rights.

12. Changes to the service or Terms

GetMuso may improve, change or discontinue features. We may update these Terms to reflect service, safety or legal changes. The effective date and version at the top identify the Terms in force. If a material update requires renewed agreement, account holders may be asked to accept it before continuing to use account features.

13. South African law

These Terms are governed by the laws of the Republic of South Africa. Any dispute is subject to the jurisdiction of the competent South African courts, without taking away any forum or remedy that applicable consumer law gives you.
